Having previously represented both public and private types of entities on many occasions in the past, we understand that municipal and private entities have different objectives and concerns when evaluating a cell site lease on their property. Schools and school district-owned property are frequently attractive sites for cell towers because many of them offer multiple locations and are typically located near densely populated areas and major highways. Similar to schools, municipal parks are another viable alternative for cell phone companies.
Additionally, police and fire department properties are often utilized by cell phone companies for the placement of cell towers. These properties are typically located in or near the center of a municipality and in many cases, the police and fire departments enter into arrangements with the cell phone companies that allow the departments to install their own antennas for emergency and first responder services on the cell phone company-owned tower. One of the reasons why police and fire departments are desirable to the cell phone companies is that, in certain cases, they are exempt from zoning or the zoning application can be expedited through the approval process.
Please note that in certain instances, it may be more profitable for the municipality to build and maintain the tower itself rather than simply leasing space to the cell phone company.
Private building or individual landowners are the most typical type of client we assist at ASI. While every property that has a cell tower located on it is unique, they all have similar attributes that make them compelling to one or more cell phone companies for various reasons i.e. they are located on a busy street corner with high traffic or pedestrian counts, they are the highest building relative to others around it, or the zoning is favorable relative to the surrounding properties, etc.
In addition to representing individuals, we have also represent Hospitals and Nursing Homes as well as corporations that own multiple properties. Similar to publicly-owned properties, these organizations typically require the collective decision-making of multiple individuals and departments or a board before entering into a cell tower lease. We know that organization of this size will need approvals from administration as well as a legal department and engineering departments. ASI has successfully worked with all types of corporations in evaluating the benefits of a cell tower installation on their property.
